November 18, 2008: Arrest Notices 11/11/08 - 11/17/08

Traffic Arrests-
On 11/11/08, an Officer stopped a vehicle in the 1500 block of Sheridan Road for a broken taillight. The driver, Jerry L Rescigno, 34, of Kenosha was arrested for driving while his license was revoked. Rescigno was later released on a personal recognizance bond and given a future court date.

On 11/15/08, an Officer while working contracted services in Wadsworth stopped a vehicle at Russell Road and Delany Road for driving without headlights when required. The driver, Mario M. Garica, 58, of Kenosha was arrested for DUI. Garica was also cited for DUI over .08 and no valid driver's license. Garica was later released on a personal recognizance bond and given a future court date.

Aggravated Battery to Police Officer and a Nurse
On 11/16/08, Winthrop Harbor's Dispatch Center received a 911 call for a possible drunk driver. An Officer located the vehicle in the 2900 block of 13th Street and initiated a traffic stop. The driver who was later identified as, Henry Benjamin, 34, of Winthrop Harbor climbed from the driver seat to the back seat of the vehicle where the Officer then made contact with him. Benjamin then exited from the vehicle and became belligerent with the Officer stating he was not driving the vehicle. Benjamin then tried to hit the Officer with his fist and the Officer attempted to restrain Benjamin. The Officer's back up arrived and they attempted to handcuff Benjamin. Benjamin continued to punch and kick at Officer's and the Officer's deployed their taser to get Benjamin into custody. After the altercation Benjamin complained of shortness of breath and Winthrop Harbor's Fire Department was called out. Benjamin continued be uncooperative with rescue and was transported to a hospital. A Winthrop Harbor Police Officer was also taken to the hospital for injuries sustained during the altercation with Benjamin. Once Benjamin was at the hospital he spat on a nurse who was trying to treat him. The hospital later released Benjamin back into the custody of the Winthrop Harbor Police Department and he was later transported to the Lake County Jail. Benjamin was cited for aggravated DUI, driving while his license was revoked (felony charge), no valid registration, improper display of registration, aggravated battery to a police officer, and aggravated batter to a nurse. Benjamin is currently being held at the Lake County Jail on a $25,000 bond.

Resisting Arrest-
On 11/17/08, an Officer stopped a vehicle at Sheridan Road and Russell Road for improper lane usage. The driver who was later identified as, Timothy M. Wienke, 31, of Kenosha gave the Officer a false name. The Officer called for an additional squad for back up. Once the Officer's back up arrived Wienke exited his vehicle and ran from the police. Officers took Wienke into custody after they fought with him for sometime. Officer's tased Wienke after he continued to fight with them. During the altercation one of the Officers was injured and later was taken to the hospital. Since Wienke ran over the state line Pleasant Prairie Police Department was contacted. Pleasant Prairie took custody of Wienke after it was discovered Wienke had two outstanding warrants for his arrest for parole violations through Kenosha County. The Winthrop Harbor Police Department will be meeting with the State Attorney's Office for charges on Wienke.
